California moves to outlaw disposable vapes, a toxic trash plague

Vape pens and other disposable e-cigarettes soon could be illegal in California.

On Wednesday, the state assembly approved Assembly Bill 762, which, if signed by Gov. Gavin Newsom, will make the battery-powered disposable devices illegal to manufacture, distribute or sell in the state. The bill passed the senate Tuesday.

“We are hopeful the Governor will recognize the threat these devices pose to our communities and that the costs of cleaning up the mess these devices leave are borne by ratepayers,” the bill’s sponsor, Assemblywoman Jacqui Irwin (D-Thousand Oaks), said in a press release.

The bill targets single-use, battery-embedded electronic cigarettes that contain tobacco products. Cannabis devices are exempt. To be legal under the new law, a vape device must be both refillable (or use replaceable pods) and have a rechargeable battery. Otherwise they couldn’t be sold after Jan. 1, 2028.

Vapes have become a trash plague on streets and beaches and in parks where they leak toxic chemicals such as lead, lithium, cobalt, cadmium, chromium, copper, zinc and nickel as well as microplastics and battery acid.

According to consumer advocacy group CalPIRG, 500,000 disposable vapes are thrown away every day in the U.S. That’s almost 5.8 devices per second.

Vapes use a small, lithium battery to heat liquids such as nicotine for users to inhale. Disposable vapes can be used only a few times before they become useless and have to be discarded.

The vaping industry says the technology saves lives and the cartridges are not nearly as bad a blight as cigarette butts.

Neither the Vapor Technology Assn., the largest industry trade group, nor the American Vapor Manufacturers, an industry group representing independent vapor manufacturers, could be reached for comment.

However, in comments last spring, a spokesman for the manufacturers, Jim McCarthy, said: “Vaping is the single most popular and effective method for Americans to quit smoking cigarettes, and it’s an absolute outrage that states like California are trying to deprive ordinary people of that life-saving product, and no state has driven more people back to combustible cigarettes than California has.”

Research shows while vaping helps more people stop smoking than conventional methods like patches or gum, it is dangerous for youths, young adults and people who don’t already smoke, since the long-term effects remain unknown. The devices deliver addictive nicotine, and the vapors can cause lung and throat irritation. Long-term use is linked to blood vessel and cardiovascular impairment.

In 2021, researchers at the Yale School of Public Health examined the consequences of San Francisco’s 2018 ban on flavored vapes. They found that after the ban took effect, the odds of underage high school students smoking conventional cigarettes more than doubled compared to school districts without a ban.

The study looked at all flavored tobacco products, including menthol cigarettes and reusable e-cigarettes.

But California’s Department of Public Health does not consider vape a positive quit-smoking method and treats e-cigarettes as a severe public health threat. The department actively works to counter the normalization of vaping, particularly among youth, and has campaigned to discourage young people from taking it up.

State health officials have said they are concerned that the nicotine in modern vape devices is highly addictive and harms adolescent brain development, affecting learning, memory and attention.

E-cigarettes also are a growing cause of fires in waste facilities. Industry analysts have coined the term “the vape effect” to describe this rise in fires, estimating billions of dollars in cumulative damages to the global waste management infrastructure.

When disposable vape cartridges are put in garbage or recycling bins, they can be crushed by garbage trucks and sorting equipment at waste facilities. This can puncture the batteries, causing them to short-circuit, overheat and potentially ignite surrounding materials.

The National Waste & Recycling Assn. (NWRA) and Resource Recycling Systems estimate more than 5,000 fires occur annually at recycling facilities, driven heavily by lithium-ion batteries.

“We don’t let other industries design products with embedded fire hazards and walk away when they fail. Vape companies shouldn’t get a pass either,” said Tony Hackett, a policy associate at Californians Against Waste.

According to the Taxpayers Protection Alliance, a national group that advocates for reduced government spending, roughly 2.2 million adults used electronic vapor products across the state in 2022 — a 40.4% increase from the year before.

The California Youth Tobacco Survey found that in 2023, vapes were the most prevalent tobacco product among high school students. It reported that 10% of students in rural areas vape and 6% in nonrural areas.

The governor’s office said it would not comment on the legislation.

As such, it has become key to achieving widespread, practical advancements in automotive electrification.

However, lithium continues to face vital long-term structural supply challenges, which has led to more EV producers considering other alternatives like manganese and magnesium.

Why magnesium?

Magnesium, another critical metal for electric vehicles and energy storage batteries, could potentially be a key alternative to lithium in EVs.

This is because it is cheaper, abundantly found across the world and also stores more energy. It is also considered to be safer than lithium, as it does not form the sharp spikes known as dendrites that cause lithium batteries to sometimes short or catch fire.

A magnesium battery can also hold more energy in a smaller space, which could have significant size and efficiency benefits for EV makers who want to make more compact vehicles.

It is also one of the most common elements found both in seawater and in the ground, which could help makers bypass potential supply constraints with lithium down the line.

Magnesium ions also carry double the charge of lithium ions, at a +2 charge, which can help support a higher volumetric capacity, enabling more compact, energy-dense power storage for both EVs and other devices.

China produces the overwhelming majority of the world’s magnesium, accounting for around 87% to 95% of the world’s primary magnesium in 2025, coming up to anywhere between 830,000 and 950,000 metric tons, according to Visual Capitalist’s Elements.

This is mainly from extensive dolomite reserves, with the largest magnesium reserves being in the Liaoning province.

The second top producer of magnesium is Israel, which extracts the metal mainly from the Dead Sea. Russia and Brazil are other major producers, with some key magnesium reserves being located in Satka and Brumado.

Manganese is also emerging as a support to lithium batteries, rather than fully replacing them. This is due to manganese batteries having a much lower energy density and not being easily rechargeable hundreds of times. They also provide lower voltage.

As such, they work well to support lithium systems in hybrid setups but fail under heavy power demands.

Why lithium supplies are fickle

One of the biggest challenges facing lithium supply is slow project timelines. This is because opening a new lithium mine takes an average of 16 to 18 years, from initial discovery to first production. This is mainly due to complex permitting rules, exploration rights and financing issues in many regions of the world.

Hard rock mining also produces significant waste and brine extraction consumes vast amounts of water in the arid regions lithium is usually found in. This leads to more scrutiny from local communities and environmental groups as well.

Similarly, due to lithium prices having crashed recently, following previous oversupply, mining investment and exploration budgets have now reduced somewhat. This significantly threatens the pipeline for future production and the global green transition.

The majority of lithium is also concentrated in Australia and South America’s “Lithium Triangle,” whereas China controls a significant portion of the refining capacity required to make battery-grade material.

Magnesium batteries?

Currently, most magnesium batteries still in the testing phase by entities like the University of Waterloo.

However, some major automakers are increasingly developing and experimenting with magnesium-rich or manganese-doped alternatives like Lithium Manganese-Rich or LMFP cells or long-term magnesium chemistry.

MG (SAIC Motor) has recently deployed new Lithium-Manganese-Oxide (LMO) semi-solid-state SolidCore battery tech in models like the MG4 EV Urban, which is scheduled to hit UK and European markets by the end of 2026.

General Motors and LG Energy Solution are currently aiming for a 2028 commerical launch for advanced lithium manganese-rich (LMR) battery cells. These use high manganese content to decrease costs and raise energy density for future electric trucks and SUVs.

Similarly, Toyota has also funded long-term dedicated research into replacing standard lithium chemistry with high-capacity magnesium alternatives. However, it is still unclear when commercial vehicles could be using this technology, as researchers are still awaiting further electrolyte stabilisation.

Great Wall Motor also uses semi-solid magnesium casting technology to reduce component weight, while Tesla integrated selective magnesium alloy components inot the Model 3 and Model Y.

Why magnesium batteries are not as widespread yet

While magnesium batteries are seeing more interest as potential alternatives to lithium now, significant challenges remain before they can be mass-adopted yet.

One of the biggest drawbacks of magnesium is slow ion movement, which means that magnesium particles move more slowly inside the battery materials.

This causes very slow charging times and weak power during fast acceleration, along with poor cold-weather performance. These factors could make it much harder for magnesium batteries to match fast-charging and high-power lithium EV batteries.

Finding a liquid, solid or electrolyte that lets magnesium move easily without breaking down is hard too, currently, as electrolytes that successfully move magnesium ions efficiently end up corroding the internal battery components.

Similarly, finding a cathode material that can withstand insertion and removal of magnesium ions without breaking down remains incredibly complex.

Under Trump, hopes for a mining boom in the Nevada desert

Some years ago, Harry Chahal and his wife were on a trip to Las Vegas when, like countless motorists before and since, they passed through this high desert speck of a town.

Tonopah, built by the mining industry around 1900 and depleted as the gold, silver, lead and mercury waned, is a remote way station about halfway between Reno and Las Vegas. Signs on either side warn — ominously, given the unforgiving expanse ahead — that once you’ve left, the nearest gas station is not for another 100 miles or so.

As he passed through town, Chahal noticed something missing: a pizza parlor.

Pizza is not generally associated with Punjab, India, where Chahal — given name Harvarinderjit — is originally from. But he learned how to make pizza, and how much customers loved gobbling it up, while working at different gas station mini-marts around rural Nevada.

In that absence, Chahal saw opportunity.

He and his wife, Ravinder, moved to Tonopah and in 2015 opened Hometown Pizza in a vacant building on U.S. Route 95, which runs through the heart of town. Ten years later, they bought the Dream Inn Motel, a 39-room operation just up the road.

Lately, Chahal has been sprucing up the motor inn: new cabinets, new furniture, fresh paint every few months. The reason is President Trump.

Tonopah and the surrounding desert, stretching farther than the eye can reckon, is verging on a boom, owing to vast reserves of lithium, boron and other sought-after materials and a Trump administration promise to turn the U.S., in the words of Interior Secretary Doug Burgum, into “a mineral powerhouse once again.”

Chahal, 40, is a repeat Trump voter and even though he has issues with some of what the president has done — he’s not happy about the war with Iran and inflation has taken a decent-sized bite out of his pizza business — he feels his faith in Republicans in general and Trump in particular have paid off.

A registered nonpartisan, Chahal is fairly apolitical. “I vote for Republicans because they’re better for business,” he said as a lunch-time crowd of locals and folks passing through tucked into the $11.99 pizza-and-salad buffet. Here’s proof: In the last year, Chahal said, he’s seen motel occupancy increase significantly, from around 15 rooms rented each night to 25 or more.

Those fresh touches to the Dream Inn are Chahal’s investment in the future and a belief that, with Trump in office, even better times lie ahead.

For much of its being, Tonopah relied on metal, minerals and other valuables scooped from the earth. Today, government is the largest employer.

But mining continues to hold fast to the town’s imagination.

A headframe — that’s the tower built directly over an underground mine shaft — is part of Tonopah’s logo. Mining-related sculptures, including statues of Jim and Belle Butler, who staked the first claim in the 20th century silver rush, dot the main thoroughfare. The high school’s athletes are called the “Muckers,” after those who shovel ore into underground rail cars.

Lately, however, mining is becoming more than just a part of nostalgic lore. It’s poised to again be a major boon to the local economy and the town’s 3,000 residents.

Plans are underway for a new lithium and boron mine at Rhyolite Ridge, approximately 30 miles southwest of Tonopah, in Nevada’s Silver Peak Range. (Lithium, most of which is now imported, is a vital ingredient in the batteries that store solar energy and power electric vehicles; boron is used, among other things, for bulletproof armor and vests.)

About 27 miles to the south of Tonopah, near the town of Goldfield, a new gold mine is set to open in 2028.

Joe Westerlund, Tonopah’s town manager, said fresh development and the prospect of hundreds of new, good-paying jobs are much welcomed. The median income here is about $37,000 annually, less than half the state average. The hospital in town closed in 2015. Venture off U.S. 95 and the rolling hills are flecked with weathered miner’s cottages and tumbledown homes no longer fit for habitation.

(A three-bedroom, two-bath home in a comfy subdivision on the north end of town can be had for around $250,000, but don’t hurry over to buy; inventory is low and could grow even leaner if demand for housing increases.)

While some of the groundwork for the mining resurgence was laid during the Biden administration, Trump is credited with fostering a much friendlier regulatory environment, which promises even more opportunities for extraction.

“As soon as he got into office, things started loosening up. We had 15 drill rigs,” said Westerlund, who has lived in Tonopah since 1972. “I had never seen that before in my life.”

There are, of course, environmental concerns — about pollution, water supply, native habitat — but those worries haven’t gained much of a toehold. Nye County, which is home to Tonopah, isn’t exactly tree-hugger country — and not just because most of the land is scrub-filled desert. Trump carried Nye County all three times he ran, with landslide support ranging from 68% to 70%.

“This is a pro-Trump town,” Westerlund said, “and I feel like his policies are doing good for the town.”

Chahal stands ready to cash in, knowing firsthand what economic good times feel like.

When he moved here in 2014, he and his wife were forced to stay in a motel for six months because workers finishing up a $1 billion solar energy project were taking up most of the living space. That’s the kind of extended-stay guest he’s after, not the tourists bedding at the Mizpah Hotel, the plushest resort in town, with its cut-glass chandeliers, Victorian furnishings and photo gallery of celebrities who’ve stayed the night.

“If I can rent 25 rooms a night, maybe 15 can be for the long term” of several weeks at a time, Chahal said. He’s done the math — $82 a night for a queen bed, single occupancy; $89 for a king — and likes how it pencils out.

Chahal came to the U.S. in 2006, after marrying Ravinder, who grew up in the Sacramento area. She had family in Punjab and was a regular visitor to India. The two met when they were 10 years old. Chahal became an American citizen in 2020.

Politically, Indian Americans lean heavily toward the Democratic Party. But in the tiny Nevada communities where the couple lived — Lovelock, Battle Mountain and Ely before Tonopah — there was little or no Indian American presence. So Chahal wasn’t acculturated into the party the way many others have been. Rather, he embraced the GOP gospel of lower taxes and less regulation.

Working seven days a week, Chahal has little time these days for politics, beyond voting. He isn’t particularly ideological or, for that matter, worshipful of Trump.

“Every coin has a head and a tail,” he said, flipping his wrist as though tossing a quarter in the air. He sees two sides to the president. “Maybe you’re angry for some things,” Chahal said. “Maybe you agree with some things.”

He supports the notion of tariffs as a way of bringing manufacturing jobs back to the U.S. He also laments that the pizza boxes he uses, which are made in China, once cost him 30 cents and now run almost 67 cents apiece.

He backs Trump’s promise to round up and deport violent criminals who are in the country illegally. But he’s also mindful of the important role immigrants play, especially in areas like farming and construction, in sustaining the U.S. economy.

Chahal criticized the heavy-handed enforcement that resulted in the killing of two protesters in Minnesota. But he blamed their deaths on overzealous ICE agents, not Trump.

Living in a town greatly shaped by outside forces — the fluctuation of commodity prices, the changing of presidential administrations, the shifting priorities emanating from Washington — Chahal is familiar with vicissitudes and the business cycles of boom and bust.

Not everything Trump has done has helped the mining industry.

His tariffs and inflation have greatly increased construction costs. Cuts to the federal workforce have slowed the oversight and approval processes. His hostility toward green energy has dampened the market for electric vehicles and made solar energy considerably less attractive.

But based on the talk around town, Chahal believes a more prosperous future is in the offing. He certainly hopes so, and he’s counting on the president to deliver.

If the Constitution allowed for a third term, Chahal said, he wouldn’t hesitate voting for Trump again.
