Kieran Culkin and wife Jazz Charton made good on their Emmys pact, recently welcoming their third child, according to the former’s “Succession” co-star.
Oscar and Emmy winner Culkin’s on-screen sister Sarah Snook, also an Emmy-winning actor, announced the arrival of the couple’s newest child while speaking to Access Hollywood on Monday. “I met the little baby, it’s so cute,” she said during the premiere of Peacock’s “All Her Fault.”
“They’re very happy and so cute,” she added.
A representative for Culkin did not immediately respond to a request for confirmation. Charton, a contributor for the Financial Times, has not yet publicly addressed the arrival of their littlest one.
“A Real Pain” star Culkin, younger brother of “Home Alone” star Macaulay Culkin, tied the knot with Charton in 2013. They share two children, Kinsey Sioux and Wilder Wolf, and lovingly teased a plan to grow their family during the 75th Emmy Awards in January 2024.
Culkin, 43, famously used part of his acceptance speech for the lead actor prize to remind Charton, 37, of the deal they had struck prior to the ceremony. As he acknowledged his wife and children, Culkin declared, “I want more.”
Charton confirmed that baby No. 3 was on the way in late September, sharing a cheeky Instagram post that also tapped into her well-documented fan love for “Matrix” star Keanu Reeves. “Saw Keanu Reeves on broadway and now I’m 9 months pregnant,” she captioned her post, which featured photos of her baby bump, “This is very on brand for me.”
She revealed she was expecting amid the debut of Reeves and longtime “Bill & Ted” collaborator Alex Winter’s production of “Waiting for Godot.” She quipped in her caption that she had “made a deal with this baby to let me make it to this [show] before labor, not sure what it wants in return but I’m CLEARLY a woman of my word.”
Snook, the first to break the couple’s baby news, has remained close to her “Succession” co-star since the hit HBO drama concluded two years ago. Culkin and Snook respectively starred as Roman and Shiv Roy, two of numerous potential — ahem — successors to media mogul Logan Roy (Brian Cox). “Succession” aired from 2018 to 2023 and won a total of 19 Primetime Emmy Awards, including acting prizes for Culkin, Snook and co-stars Jeremy Strong and Matthew Macfadyen.

The Canadian singer-songwriter announced her pregnancy Monday in an Instagram post, sharing a few black-and-white photos of the couple and Jepsen’s baby bump that hint there may be some kicking going on.
“Oh hi baby,” Jepsen, 39, wrote in the caption along with a heart emoji. Her 40-year-old husband, whose full name is Cole Marsden Greif-Neill, is feeling so much love and excitement that he has been rendered speechless, if the multiple heart-eyes emojis are any indication.
According to the couple’s wedding spread in Vogue, Jepsen and the Grammy Award-winning producer tied the knot in October, and the couple had been trying to get pregnant while planning their New York wedding. The musicians first met as colleagues in 2021 and started dating in 2022 before getting getting engaged in September of last year.
In 2023, Jepsen told People that their first collaboration, the song “So Right” from her album “The Loveliest Time,” was in essence the couple’s “meet-cute.”
“This is our first little baby out in the world,” Jepsen told the outlet at the time. “I think you’ll see a lot more of our collaboration together for future projects.”
Known for her earworm 2012 hit “Call Me Maybe,” Jepsen most recently celebrated the 10th anniversary of the release of “Emotion” with a sold-out show at the Troubadour, where she performed the entirety of the 2015 album.
“‘Emotion’ was like an introduction to my authentic version of what pop music was,” Jepsen said of the LP in 2020. “I was itching to share something different, because I knew that ‘Call Me Maybe’ wasn’t the only color of what I had to offer.”
A nine-month-old baby has been killed in a dog attack in south-east Wales, according to Gwent Police.
Officers and paramedics went to a property on Crossway in Rogiet, Monmouthshire, at about 18:00 GMT on Sunday.
The dog was seized and removed from the address, the force said.
Police were working to establish the breed of the animal and no arrests had been made.
Ch Supt John Davies said: “Officers are on scene and will be making further inquiries as the investigation progresses.”
Residents said they were in disbelief at the death of the child, with the community in shock and trying to come to terms with what had happened.
They said they saw police cars and ambulances on the quiet residential street in south Wales at the time of the incident.
By 22:00 the police cordon had been lifted and all the ambulances and most police cars had gone, replaced by scenes of crime investigation vehicles.
At this time two police officers were still guarding a house on Crossway, a street now silent but for the hum of cars on the M4 and trains on the south Wales to London line.

On the pod Keira was asked by Giovanna “if the whole Nepo Baby thing annoyed” her.
Giovanna continued: “I think it’s a really difficult subject when you’ve got parents who are working and they’re jobbing creatives. You know but you still have to deliver. You still have to have a talent.”
Keira replied: “I don’t know about annoyed, I think I am a Nepo Baby.
“I mean my first proper agent was because she was my mum’s best mate, and she’s still my agent today. So, I mean, I think it is true that there are connections that are made, and it’s true that within creative families, you know, a lot of the actors I know, it is generational.
“And I think partly that is because it is a lifestyle; it’s a way of life that is quite other from a 9-to-5 job.”
She was then asked: “So, do you think it’s more a case, that we have to change our view of how we perceive even the word ?”
“Well I don’t know about that. I think it’s a similar thing to quite often builders, I was doing a lot of work on my house recently, and it’s a family of builders,” Keira quipped.
“You know, building companies go through generations. Doctors tend to go through generations. You get a lot of lawyers, I think you grow up in a particular environment, and if you like the environment you grew up in you will gravitate towards that environment.
Giovanna added: “Though you don’t see a doctor whose dad’s a doctor and go, “Nepo Baby”.
“No, you don’t. I mean, but look, the entertainment industry is very loud, the noise around the entertainment industry and I think you know that going into it.
Speaking about her two children, whom she shares with musician James Righton, she added: “If my children, neither of them are showing any interest whatsoever, but if that’s what they choose to do, then that’s what they’ll have to deal with. And I’m sure they’ll have an answer to it.
“Ultimately, with every job, no matter what it is, you might have help through the door, which is not nothing. But unless you bring the goods, you’re going to be chucked out very quickly.”

Chris Evans might need some new superhero gear for his next gig. Perhaps a supercharged stroller?
The Marvel alum, 44, and his wife, Portuguese actor Alba Baptista, 28, on Friday welcomed their first child together in Evans’ home state of Massachusetts, People reported Tuesday. The couple named their newborn daughter Alma Grace Baptista Evans, according to the outlet.
Representatives for Evans and Baptista did not reply immediately Tuesday to The Times’ request for comment.
Evans and Baptista, who began dating around 2021, wed in 2023 in a pair of ceremonies in Cape Cod and Portugal, Evans explained amid much fanfare during a panel that year at New York Comic Con. The couple’s East Coast nuptials were attended by Evans’ fellow Marvel legends Robert Downey Jr. (Iron Man), Chris Hemsworth (Thor), Jeremy Renner (Hawkeye) and Scarlett Johansson (Black Widow), Page Six reported at the time.
During the Comic Con panel, Evans called the festivities “wonderful and beautiful,” but said that he and his belle were happy to be winding down after the whole ordeal.
“Planning a wedding, it’s a lot,” he said. “For those of you who are married, you know, it takes a lot out of you, but now that we’re through that, we’ve just kinda been enjoying life and gearing up for autumn, my favorite season. It’s the latest saga surrounding his music career after a concert goer called out inappropriate jokes and bizarre segments at his concerts.
Sombr played a show in Washington, D.C. earlier this month, which 25-year-old TikTok user Megan Tomasic attended.
She posted a videoon Wednesday recapping the whole experience, calling it “genuinely the worst concert” she’d ever seen.
She quickly realised she wasn’t the target audience – describing “thousands of tweens running around like they were at a middle-school dance” at the concert.

A parole hearing to decide whether to re-release the mother of Baby P, who was jailed over his death following months of abuse, has heard “extremely moving” victim statements from the child’s loved ones.
Tracey Connelly was jailed at the Old Bailey in 2009 for causing or allowing the death of her 17-month-old son Peter – known as Baby P – at their home in Tottenham, north London, on 3 August 2007.
The public hearing is being held to decide whether she can be re-released or if she can be moved to open conditions.
Sally Allbeury from the parole board panel told the hearing on Wednesday that it had heard statements by Peter’s loved ones in private about their concerns about parole being granted.
“Those statements told the panel about the ongoing impact on the authors’ of Peter’s death and their concerns about Ms Connelly’s potential release,” Ms Allbeury said.
“Each one has also requested in the event of Ms Connelly’s release that certain conditions be put in place to protect them.
“We found these statements extremely moving.
“There can be no doubt that Peter’s death has caused lifelong harm to those who loved him.”
The parole board ruled she was suitable for release in March that year – after hearing she was considered to be at “low risk of committing a further offence” and that probation officers and prison officials supported the plan.
This was despite the panel highlighting concerns over Connelly’s ability to manipulate and deceive, and hearing evidence of how she had become embroiled in prison romances and traded secret love letters with an inmate.
Then-justice secretary Dominic Raab appealed against the decision, but a judge rejected his bid to keep her behind bars.
She had previously been released on licence in 2013 but was recalled to prison in 2015 for breaching her parole conditions.
Three previous parole bids, in 2015, 2017 and 2019, were rejected.

Receptive to tenderness but prone to violence, the nameless Creature now has, in Elordi, a performer suited for all its unruly emotions. “It was the innocence in Jacob’s portrayal that kept getting me,” says makeup artist and prosthetics designer Mike Hill. “The Creature could snap on a dime like an animal.”
Capable of complex thought, Del Toro’s version of the monster ponders the punishment of existence and the cruelty of its maker. “They’re almost like John Milton questions to the creator,” the director says of the Creature’s dialogue. “You have to give it a physicality that is heartbreakingly uncanny but also hypnotically human.”
The imposingly lanky, gracefully handsome Elordi, born in Australia, has risen in profile over the last few years, thanks to roles in the hit series “Euphoria” and the psychosexual class-climbing thriller “Saltburn.”
“It came from some other place,” Elordi says about the pull to the role of the Creature. “It felt like a growth, like a cancer in my stomach that told me that I had to play this thing.”

“Early in my career, I had been reading what folks on the internet would say about me and someone had written after my first film, ‘The only thing this plank of wood could play is Frankenstein’s Creature. Get him off my screen!’” Elordi recalls. “I went, ‘That’s an absolutely fantastic idea.’”
The thought reentered Elordi’s mind while making Sofia Coppola’s 2023 “Priscilla,” in which he played a moody, internal Elvis Presley to Cailee Spaeny’s title character. Long before he was offered the part, the hair and makeup team on “Priscilla” shared with him their next job was, in fact, Del Toro’s “Frankenstein.”
“I looked at [hair designer] Cliona [Furey] and I said, ‘I’m supposed to be in that movie.’ And she said, ‘Did you audition?’ And I was like, ‘No, but I’m meant to be in that movie.’”
“It came from some other place,” Elordi further explains. “It felt like a growth, like a cancer in my stomach that told me that I had to play this thing. I’ve heard stories about this from actors, and when you hear them, you kind of go, ‘Sure, you were meant to play this thing.’ But I really feel like I was.”
Due to scheduling conflicts, Andrew Garfield, originally cast as the Creature, dropped out in late 2023. With production set to start in early 2024, Del Toro had limited time to find a new actor. When Elordi finally heard he was being considered, he had to read the screenplay within hours of receiving it, and be willing to dive into the darkness.
“I had a few weeks to prepare, but I was lucky to have also had my whole life — and I mean that sincerely,” he says, a grin crossing his face. “Playing this was an exploration into a cave of the self, into every experience with my father, with my mother, my experience with cinema, my scraped knees when I was 7.”
Del Toro says he knew Elordi would make the perfect Creature from speaking with him over Zoom. He remembers immediately messaging Isaac, his Victor, convinced that Elordi could play both “Adam and Jesus,” which are the two facets that the creature represents for the director.

“I don’t think I’ve experienced miracles many times in my life,” Del Toro says. “And when somebody comes to your life in any capacity that transforms it, that happened here. This man is a miracle for this film.”
As he typically does for all the actors in his films, Del Toro sent Elordi several books ahead of working together. Elordi’s deep-dive reading list included the bedrock Taoist guide “Tao Te Ching,” Stephen Mitchell’s well-regarded translation of the Book of Job and a text on the developmental stages of a baby.
The most complex element of the performance, Del Toro believes, is playing “nothing,” meaning the blank, pure state of mind of a living being in infancy. “A baby is everything at once,” Elordi says. “It’s deep pain, deep joy, curiosity. And you don’t have chambers for your thoughts yet.”
Right before “Frankenstein,” Elordi had been shooting Prime’s World War II miniseries “The Narrow Road to the Deep North” in Australia, an experience he describes as “grueling,” one that involved losing substantial weight. He repurposed his body’s subsequent fragility as a dramatic tool.
“My brain was kind of all over the place,” he remembers. “I had these moments of great anguish at around 3 a.m. in the morning. I’d wake and my body was in such pain. And I just realized that it was a blessing with ‘Frankenstein’ coming up, because I could articulate these feelings, this suffering.”
Aside from being an outlet for his exhaustion, the transformation also helped Elordi to recalibrate. “Frankenstein” arrived at a time where he found himself wrestling with a crisis of purpose.
“At that time in my life I really wanted to hide,” Elordi says. “I really wanted to go away for a while. I was desperate to find some kind of normalcy and rebuild the way that I acted and how I approached making movies,” Elordi says. “And when the film came along, I remember being like, ‘Ugh, I really wanted to go away right now.’ And I realized immediately the Creature was where I was supposed to go away to. I was supposed to go into that mask of freedom.”
Was he trying to escape the pressures of dawning fame? Elordi says it was much more philosophical than that.
“Who do I think I am? Who do I present myself as? What do I like? What don’t I like? Do I love? Can I love? What is love? Every single thing of being alive,” he says with a radiant smile. “The unbearable weight of being.”
“At that time in my life I really wanted to hide,” Elordi says of the moment just before taking on Del Toro’s version of the classic. “I really wanted to go away for a while. I was desperate to find some kind of normalcy and rebuild the way that I acted and how I approached making movies.”

The part entailed physically burying himself in another body. It allowed Elordi to renounce any hang-ups, surrendering to a fugue state of mind. Every moment felt like a discovery.
“I was liberated in this makeup,” he adds. “I didn’t have to be this version of myself anymore. In those six months, I completely rebuilt myself. And I came out of this film with a whole new skin.”
Elordi sat for 10 hours in the makeup chair on days that required full body makeup — only four if they were only shooting the Creature’s face. “Jacob wanted to wear the makeup and he knew it would be grueling,” Hill says.
“It was nothing short of a religious experience,” Elordi says. “The excitement I had even just getting my body cast — I was buzzing.”
Hill believes that the decision to make the Creature bald for the scenes where he is a “baby” is what makes Del Toro’s take unique within the “Frankenstein” mythos.
“Instead of what happens in cloning where a baby grows, Victor literally did make a baby, just a big one,” says Hill. “The Creature learns quickly because its brain and its bodies have already lived once. God knows what this Creature knew before he forgot and needed to be reminded.”
As for the skin, Del Toro envisioned a marble-statue look that he had been pursuing in earlier movies like “Cronos,” “Blade II” and “The Devil’s Backbone.”
“Mike took it and made it incredibly subtle: flesh with the violets and the purples and the pearlescence,” Del Toro says. “He bested every concept I’ve ever imagined by making it look like parts of exsanguine bodies. That was so brilliant.”

A Frankenstein’s monster with rainbow-colored flesh, Hill says, could only exist in the context of a Del Toro picture.
“He had to look beautiful, like a phrenology head or an anatomical manual,” Del Toro adds. “We agreed — no scars. No sutures. No vulgarity.”
Del Toro’s casting of Elordi was fully validated when the actor walked on set for the first time in full makeup. “The whole process was anticipation,” Elordi says. “And then I opened my eyes and he was looking back at me, and it was exactly what I thought it would be when I first read the screenplay.”
For Hill, it was watching Elordi doing an interview, where his limbs seemed loose and relaxed, that convinced him he was the right actor to sculpt the Creature on. “I was like, ‘Look at those wrists.’ And then he turns, and he has these lashes,” Hill says. “Big eyes are beautiful for makeup. And structurally, Jacob has an unassuming nose, so you can build on that.”
“And he has a big chin,” Hill continues amid Del Toro’s boisterous laughter. “I was like, ‘I’m not going to glue one on.’”
Amused at his anatomy being dissected in front of him, Elordi claps back, mock-defensively: “He was grotesque to look at, but he was somewhat gifted. A deformed skinny freak.”
By the time Elordi got out of the makeup chair, he says, the electricity in his body had shifted. He stepped on set physically depleted but in the ideal headspace to embody the creature as it navigates an inhospitable reality.
“He’ll forever be fused into my chemistry,” Elordi says. “He was always there and now I have a little place for him. But I can’t rationalize him.”
Whether by curse or by miracle, Elordi’s Creature lives. And the actor feels reborn.

And last week saw her collaboration with her mum for a high-profile Gap shoot.
But the 21-year-old model, singer and socialite insists we should all forget the nepo baby label — because it’s all thanks to her parents “instilling a work mentality in her”.
“I should not be entitled to anything, I have to work,” she said in a recent interview.
But what Apple means by “work” is raising a few eyebrows in the world of showbiz.
Singing on records by her dad’s band Coldplay, cameos in her mum’s Netflix documentaries, and even a movie role — despite having zero acting experience — are only fuelling accusations that she could well be this year’s ultimate nepo baby, or the child whose success is seen as resulting from their parents’ connections.
A showbiz insider said: “Apple has all the qualities to be the new It girl.
“She’s got girl-next-door looks and has a sweet and innocent demeanour, but deep down she has a wild side.
“She’s sure to ruffle a few feathers as she makes her way in the modeling world.
“And whether she likes it or not, she’s definitely one of the nepos to watch.”
But showing she is not afraid to hit back at the naysayers, the fiery model said: “I constantly remind myself how grateful I am to have these opportunities. I know this is not a normal way to grow up, by any means.
“But my parents did a really good job of instilling in me that I shouldn’t be entitled to anything.”
Apple claims she always wanted to be a model, recalling how she “did run runway walks” in her bedroom while dressed for school, practising her version of Ben Stiller’s Blue Steel pose from the film Zoolander.
She said: “I’ve always been obsessed with fashion. I remember when my mum would do fittings for photoshoots when I was younger, I’d love to just hang out while she was getting her make-up done on set.”

Given that dad Chris is the super-clean frontman of the world’s most inoffensive band, Apple’s personality — as well as her looks — is perhaps more aligned with her Hollywood-star mum, who knows all too well about divisive images.
Gwyneth — herself the nepo baby of film director Bruce Paltrow and actress Blythe Danner — was a self-confessed party girl in the Nineties and famously bragged about loving the buzz of “doing cocaine and not getting caught” during her twenties in New York.
It’s yet to be seen how Apple gets her kicks on a night out, but her parties have certainly gained quite a reputation after police were forced to shut down one particularly raucous bash in 2022 with 50 of her pals at Gwyneth’s estate in the Hamptons — the affluent seaside resort on New York’s Long Island.

Mum was out of town at the time but according to neighbours, the revellers were “partying like rock stars” and made so much noise, angry locals had no choice but to call the cops.
Apple reportedly ended up receiving a fine for hosting a gathering without a permit. Her parents have a combined worth of £320million, so it’s unlikely she would have struggled to pay it.
Apple, who was born in London, was educated in California, attending the £30,000-a-year Harvard-Westlake School in Los Angeles, where she graduated in 2022.
She is now studying English and history at Vanderbilt University in Nashville, Tennessee.
Her taste for fashion has been evident since she got a job in a clothes shop aged 15.

She attended her first runway show in 2023, sitting front row at the Chanel Haute Couture show in Paris, and said afterwards she was developing her own style, a mix of “classic ’90s and cool grandpa”.
Apart from brief appearances in her mum’s Netflix shows and Instagram pictures, as well as singing on Coldplay songs — including 2021 single Higher Power — Apple has only entered the limelight in the last few years, when signs of her personality have begun to shine through.
In April this year she gave a bolshy take on growing up in the public eye for high-end fashion mag Interview — where she worked as an intern — in which she admitted she used to be “anxious about making mistakes”.
She added that she had been put off showbiz because “I don’t think we need another celebrity child in the world.”
She continued: “I just try to do what feels right and block out anything regarding me in the news to the best of my ability.
“And I’m getting a lot better at being like, ‘F*** it’. I’m not going to be scared. I just want to do what seems fun and figure my life out.”
But Apple’s steely approach was put to the test last year when she made her debut at the high-society Le Bal des Débutantes — a modern version of the old debutante ball — in Paris.
The bash at the $1,000-a-night Hotel Shangri-La was supposed to signal her arrival, in a stunning Valentino gown, as a new Hollywood power player.
But instead Apple suffered an online backlash after she was accused of deliberately photobombing a fellow guest and forcing her out of the frame, then pouting and posing for several photos.

After the footage went viral, social media users branded her “obnoxious”, “entitled” and “giving Regina George” — a reference to the notorious queen bee in the 2004 movie Mean Girls.
But rather than give a mature response, Apple instead poked fun at the situation, posting a video on TikTok with a pal jokingly stating that they are both “a delight” and “very funny” — which only served to earn her the nickname “Rotten Apple”.
Gwyneth was also at the ball with ex-husband Chris and Apple’s 19-year-old brother Moses, who is the lead singer in up-and-coming band Dancer.
She has previously admitted that despite Apple’s recent claims that her parents don’t want her to be “entitled”, there is little doubt that she is — but Gwyneth sees it as positive.
Talking about Apple and her pals, she said: “They have, and I mean this word in the best possible way, a sense of entitlement that’s beautiful.
“It’s not spoiled . . . I find it very uplifting and heartening that we all seem to be going in this direction together.”
Even so, Gwyneth knows Apple’s spiky side too, having received a ticking off from her for posting a snap of her on Instagram when she was 14.
Apple commented under Gwyneth’s post, ranting: “Mom we have discussed this. You may not post anything without my consent.”
Sassy response
She later deleted the remark after her mum replied: “You can’t even see your face.”
Apple also gave a sassy response when her mum posted a picture of herself making breakfast while topless, writing: “Did I steal your shirt by accident”.
And she also ripped into Gwyneth’s morning routine while trolling the TikTok account of her lifestyle brand Goop, saying: “She eats nothing except for dates and almond butter,” adding that Gwyneth had been on a cleanse “since the day I was born, apparently”.
But when asked how she stays grounded, Apple said: “Hanging out with my friends and trying to have a normal college experience makes me feel more normal.
“That’s how I like to unwind. We’ll sit down and do little guitar playing sessions, one person will play and the others will sing.
“I also love watching reality TV with my friends. There was one day we spent five hours on the couch and just watched old episodes of America’s Next Top Model.”

A Texas court has issued a stay of execution for Robert Roberson, a man whose 2003 murder conviction has raised serious questions about the validity of “shaken baby syndrome” as a medical diagnosis.
Thursday’s decision arrived with only a week remaining until Roberson’s scheduled execution date on October 16.

Roberson, a 58-year-old autistic man, was accused of having killed his two-year-old daughter Nikki Michelle Curtis in January 2002, after he brought her to a hospital emergency room unconscious.
He has maintained that Nikki had been sick and fell from her bed overnight. But prosecutors argued that her head trauma must have been caused by “shaken baby syndrome”, a diagnosis popularised in the late 1990s as evidence of physical abuse in infants and toddlers.
But that diagnosis has been increasingly rejected, as doctors and medical researchers point out that the symptoms of “shaken baby syndrome” — namely, bleeding or swelling in the eyes or brain — can be caused by other conditions.
Roberson’s defence team has argued that Nikki suffered from chronic pneumonia in the lead-up to her death, and the medications she was given, including codeine, contributed to her death.
In Thursday’s decision, the judges on the Texas Court of Criminal Appeals agreed to pause his execution in light of a similar case being overturned in 2024.
Judge Bert Richardson contrasted the shifting nature of the medical research with the finality of execution in his concurring opinion.
“There is a delicate balance and tension in our criminal justice system between the finality of judgment and its accuracy based on our ever-advancing scientific understanding,” Judge Richardson wrote.
“A death sentence is clearly final and, once carried out, hindsight is useless. Thus, when moving forward in such a way, we should require the highest standards of accuracy so that we can act with a reliable degree of certainty.”
But the court limited its judgement to reopening Roberson’s petition for habeas corpus, which questions the constitutionality of a person’s imprisonment.
It declined to reconsider Roberson’s case as a whole. That prompted some of the judges on the court to issue a partial dissent.
Judge David Schenck, for instance, argued that “a new trial is necessary and mandated by our Constitution”, given the new evidence that has emerged in the two decades since Roberson was sentenced to death.
“The merits of Roberson’s claims and the cumulative effect of the evidence Roberson presents — in his fifth application as well as his previous and subsequent applications — would be more properly and more swiftly assessed at this point by a jury in a new trial,” Schenck said.
He added that a new trial would also offer the state of Texas “an opportunity to present this case on its merits”.
Still, some judges on the panel said they were opposed to reopening the case, arguing that the shift in medical consensus did not rule out an act of violence in Nikki’s death.
“Arguably credible and reliable scientific evidence still exists to suggest that shaking a child can cause serious injury or death,” Judge Kevin Yeary wrote in his opinion.
This is not the first time that Roberson’s case has been delayed. He has spent nearly 23 years on death row and was also slated to be executed a year ago, in October 2024.
But that execution date was scuttled in an extraordinary series of events. With his execution scheduled for October 17 of that year, a bipartisan group of legislators in the Texas House Committee on Criminal Jurisprudence agreed to issue a subpoena for Roberson on October 21 — effectively setting up a battle between the legislature’s will and the court’s.
The subpoen sparked a court case about the separation of powers in Texas: A witness could not answer a legislative subpoena if the justice system executed him first.
Further, the members of the Texas House committee had argued that a 2013 state law barring the use of “junk science” in court cases had failed to be applied in Roberson’s case.
The case reached the Texas Supreme Court, which halted Roberson’s execution while the matter was resolved. Execution dates are set with at least 90 days’ notice in Texas, resulting in a prolonged pause.
On July 16, after appeals from Roberson’s defence team, a new execution date was set for this month.
Texas Attorney General Ken Paxton, a Republican, has accused critics of Roberson’s sentence of “interfering with the capital punishment proceedings” and has repeatedly pledged to push forward with the execution.
But even those involved in Roberson’s original capital murder trial have sought to see his sentence overturned.
Brian Wharton, the lead investigator in Roberson’s case, had once testified in favour of the prosecution. But last year, he told the Texas House committee that he supported Roberson’s appeal, given the new evidence that has come to light.
“He is an innocent man, and we are very close to killing him for something he did not do,” Wharton said.
On Thursday, one of the jurors who helped convict Roberson also published an opinion column in the Houston Chronicle, asserting that she was “wrong” to side with the prosecution.
“If we on the jury knew then what I know now — about the new evidence of Nikki’s missed pneumonia, how her breathing would have been affected by the Phenergan and codeine doctors gave her that last week, the signs of sepsis, and all the things that were wrong with the version of shaken baby syndrome used in the case — we would have had a lot more to discuss,” Terre Compton wrote.
“Based on all that has come out since the trial, I am 100% certain that Robert Roberson did not murder his child.”
Texas has executed 596 people since 1982, the most of any state.

Being so central, you can normally expect hotels to have high prices – the nearby Ritz and the W Hotel can command nightly rates of £500 or more.
Not Zedwell – the new hotel claims to be the world’s biggest capsule hotel, and with that, comes the small price of just £30 a night.
That definitely makes it the cheapest hotel room in the city (unless you want to bunk up in an 18-bed dorm).
Having opened last month, it sits directly above Piccadilly Circus Underground Station, so tourists would walk by without knowing this ultra trendy hotel was there.
With the door currently hidden under scaffolding, I almost missed it too.
But what is it really like to stay there?
Inside, decked out with a modern concrete and timber design, there are nearly 1,000 individual sleep capsules over five floors.
Guests use an iPad to self-check in, before being directed to one of the correct floor and room.
Each dorm needs a key card to access, too, so you can only enter the dorm you are assigned, which definitely makes it feel secure.
It’s a twist on the traditional ‘dorm style’ hostel set up as each guest gets privacy and security of being tucked up in your capsule, with the ability to lock it from the inside.

Choosing a female-only room (there are also male-only and mixed), each of the square pods were stacked with a top and bottom pod.
On first glance, the dorm rooms, which are minimalist and dimly-lit looked a bit like a car park or a storage locker.
It’s nothing like you’d expect a hotel room to look, so it takes some getting used to.
I wasn’t sure how much I wanted to sleep in a multi-story car park.
However, inside, I was surprised to find a cute little space, with mood lighting and welcoming interiors.
Each capsule is made from oak and come with a single Hypnos mattress, Egyptian cotton bedding, individual mini aircon or heat, smart climate control, noise reduction, and ambient lighting.
There is also a plug socket inside, two USB plugs and a mirror.
However, being a private pod ‘room’ means there isn’t much storage space – there are no room for suitcases inside.

You have to leave them outside your capsule, so be sure to put your valuables in the pod when you lock it or take them with you.
If you want to leave your case at the hotel after you checkout, the hotel charges £15 to store them securely with them.
Make sure to bring your own padlock too, so you can lock your pod if you plan on going out (although reception let you buy them on-site as well).
There are clean common areas too, which felt more adult then teen-backpacker, which includes a lounge and co-working space.
I was impressed with how clean the communal bathroom and toilet area as well, with light jazz music playing overhead.
But the big question – how did I sleep?

More used to a double bed than being boxed in by four walls, pulling the door down behind me feeling a little bit like a Sylvanian Family creature shutting themselves in a mini garage.
Surprisingly, it didn’t feel as claustrophobic as I thought it would – as a 5″5 woman, I was able to sit up and easily stretch my legs.
Even more surprisingly, I had a great night sleep, with no rowdy drunken people or loud talkers disturbing the peace.
I did get woken up once by someone opening up their dorm door at 4am.
With each pod door made from plastic and metal, it means they don’t open and close too quietly.
Aside from that, I couldn’t fault my stay. In fact, it was so quiet and dark, I actually slept in an hour later than I usually wake up.
The hotel itself felt very safe too, with a security guard on the door and someone in reception 24-hours a day, as well as CCTV on each floor.
And even outside, the central location means everything you need is on your doorstep, from the London’s West End to Chinatown.
It’s great for friendship groups or solo travellers or if you have a big night out in Soho planned and don’t want to get the tube home.

The city is crying out for affordable places to stay and for £30? It can’t be beaten.

Other photos in the post shared to Instagram showed the Aussie actress sitting beach side in a white top and skirt, and where her baby bump was proudly on full display.
Also in the photos was her partner, Cyrus Sutton, a US filmmaker, surfer and the owner of a luxury spa home in Washington State.
