President Trump’s administration can continue to detain immigrants without bond, marking a major legal victory for the federal immigration agenda and countering a slew of recent lower court decisions across the country that argued the practice is illegal.

A panel of judges on the 5th Circuit Court of Appeals ruled Friday evening that the Department of Homeland Security’s decision to deny bond hearings to immigrants arrested across the country is consistent with the Constitution and federal immigration law.

Specifically, Circuit Judge Edith H. Jones wrote in the 2-1 majority opinion that the government correctly interpreted the Immigration and Nationality Act by asserting that “unadmitted aliens apprehended anywhere in the United States are ineligible for release on bond, regardless of how long they have resided inside the United States.”

Under past administrations, most noncitizens with no criminal record who were arrested away from the border had an opportunity to request a bond hearing while their cases wound through immigration court. Historically, bond was often granted to those without criminal convictions who were not flight risks, and mandatory detention was limited to recent border crossers.

“That prior Administrations decided to use less than their full enforcement authority under” the law “does not mean they lacked the authority to do more,” Jones wrote.

The plaintiffs in the two separate cases filed last year against the Trump administration were both Mexican nationals who had lived in the United States for more than 10 years and weren’t flight risks, their attorneys argued. Neither man had a criminal record, and both were jailed for months last year before a lower Texas court granted them bond in October.

The Trump White House reversed that policy in favor of mandatory detention in July, reversing almost 30 years of precedent under both Democrat and Republican administrations.

Friday’s ruling also bucks a November district court decision in California, which granted detained immigrants with no criminal history the opportunity to request a bond hearing and had implications for noncitizens held in detention nationwide.

Circuit Judge Dana M. Douglas wrote the lone dissent in Friday’s decision.

The elected members of Congress who passed the Immigration and Nationality Act “would be surprised to learn it had also required the detention without bond of two million people,” Douglas wrote, adding that many of the people detained are “the spouses, mothers, fathers, and grandparents of American citizens.”

She went on to argue that the federal government was overriding the lawmaking process with the Department of Homeland Security’s new immigration detention policy that denies detained immigrants bond.

“Because I would reject the government’s invitation to rubber stamp its proposed legislation by executive fiat, I dissent,” Douglas wrote.

Douglas’ opinion echoed widespread tensions between the Trump administration and federal judges around the country, who have increasingly accused the administration of flouting court orders.

U.S. Atty. Gen. Pam Bondi celebrated the decision as “a significant blow against activist judges who have been undermining our efforts to make America safe again at every turn.”

“We will continue vindicating President Trump’s law and order agenda in courtrooms across the country,” Bondi wrote on the social media platform X.

Davina McCall broke down in tears during an emotional discussion with husband Michael Douglas. Davina and Michael tied the knot recently in an “absolutely beautiful” ceremony in front of their friends and family.

It came just three months after Davina, 58, announced that she and celebrity hairstylist Michael got engaged during a trip to Ibiza. The couple first started dating in 2018, having met originally on the set of Big Brother in 2000.

Their marriage came after a difficult year for Davina, who underwent surgery in November 2024 after medics discovered a colloid cyst on her brain. Just over a year later she revealed she had been diagnosed with breast cancer after finding a small lump.

Now on the Making the Cut podcast, Davina’s husband Michael praised the television presenter for using her fame to speak candidly about her health battles and “help a lot of people”.

It came after Michael recently read Bruce Springsteen’s autobiography. In the book, the Boss spoke candidly about his music and his life, something Michael said he found to be a “therapeutic experience”.

Michael said: “I realised the important role that famous people can have in regular people’s lives. Bruce putting his life in the paper or out there has helped me.

“I realised what it means to be married to someone like you who also does that and what it’s like to be around someone who puts themselves out in a way that is to benefit and help other people and I want to say, well done you.

“I realise what you stand for for a lot of people and I see them stop you in the street and say how grateful they are for what you decided to do with your fame and your time. In a way that Springsteen helped me, I realised you helped a lot of people.”

The touching words from her husband made The Masked Singer panellist Davina audibly tear up. Davina will return to screens with Long Lost Families tonight (January 29) from 9pm on ITV One.

The series sees Davina and co-host Nicky Campbell reuniting people with their loved ones. Tonight the series will visit Mandy whose parents had a baby girl they placed for adoption, she is now attempting to find her long-lost big sister.

Elsewhere Jane thought she was an only child until her mother revealed she had a baby boy 11 months before her. Jane now wants help finding her long lost brother who was put up for adoption.

Davina has previously spoken about the emotions she feels when reunited siblings, especially because she lost her sister to cancer in 2012. Caroline, 50, was diagnosed with lung cancer after being rushed to hospital after suffering a suspected stroke.

Speaking to Love TV, she said: “Sometimes with siblings, it’s quite hard and painful, because one sibling might have grown up with their birth family, while the other was placed for adoption. There’s a lot to unpack there, you know?”

Davina says the show’s genealogists occasionally track people down who weren’t even aware they had a sibling. “Imagine being gifted a sibling out of the blue, it would be absolutely mad,” she added.

Aston Villa have agreed a deal to re-sign former midfielder Douglas Luiz on loan.

The 27-year-old is currently on loan at Nottingham Forest from Juventus, but is set to leave the City Ground before Monday’s transfer deadline and join Villa.

Chelsea were also interested in the Brazil international but sources told BBC Sport his preference was Villa, where he made 204 appearances between 2019 and 2024.

Villa sold Luiz to Juventus for £42.5m in June 2024 to help solve their profit and sustainability problems, but he made just three Serie A starts before joining Forest in August 2025.

Villa boss Unai Emery is looking to bolster his midfield options, with captain John McGinn out for up to two months with a knee issue and Boubacar Kamara expected to miss the rest of the season with a knee injury.

Emery’s side lost out on Conor Gallagher earlier this month after the England international opted to join Tottenham from Atletico Madrid for £35m.
