Australia’s highest court rejects Candace Owens’ visa challenge

Australia’s highest court on Wednesday rejected U.S. conservative commentator Candace Owens ’ bid to overturn an Australian government decision barring her from visiting the country.

Three High Court judges unanimously rejected Owens’ challenge to Home Affairs Minister Tony Burke’s decision in 2024 to refuse her a visa on character grounds.

Owens had planned to begin a speaking tour in Australia last November and also visit neighboring New Zealand.

Burke used his powers under the Migration Act last October to refuse her a visa because she failed the so-called “character test,” court documents said.

Burke found there was a risk Owens would “incite discord in the Australian community” and that refusing her a visa was in the national interest.

Burke found that as a political commentator, author and activist, Owens was “known for her controversial and conspiratorial views.”

She had made “extremist and inflammatory comments towards Muslim, Black, Jewish and LGBTQIA+ communities which generate controversy and hatred,” Burke said in court documents.

Owens’ lawyers had argued the Migrant Act was unconstitutional because it infringed upon Australia’s implied freedom of political communications.

Australia doesn’t have an equivalent of the U.S. First Amendment that states a right to free speech. But because Australia is a democracy, the High Court has decided that the constitution implies free speech limited to governmental and political matters.

Owens’ lawyers had argued that if the Migration Act was constitutional, then Burke had misconstrued his powers under that law in refusing her a visa.

The judges rejected both arguments and ordered Owens to pay the government’s court costs.

Burke described the ruling as a “win for social cohesion.”

“Inciting discord might be the way some people make money, but it’s not welcome in Australia,” Burke said in statement.

Owens’ spokeswoman told The Associated Press on Wednesday Owens would comment on the court decision later on social media.

Burke had told the court that while Owens already had an ability to incite discord through her 18 million followers across social media platforms, her presence in Australia would amplify that potential.

He noted that when Australia’s terrorism threat level was elevated from “possible” to “probable” last year, the national domestic spy agency reported an “increase in extremism.”

Australia has long used a wide discretion under the character test to refuse foreigners temporary visas.

Burke stripped Ye, the U.S. rapper formerly known as Kanye West, of an Australian visa after he released his single “Heil Hitler” in May this year.

Ye had been traveling for years to Australia, where his wife of three years, Bianca Censori, was born.

Burke’s decision to ban Owens prompted neighboring New Zealand to refuse her a visa in November on the grounds that she had been rejected by Australia.

But a New Zealand immigration official overturned that refusal in December, citing “the importance of free speech.”

Owens’ spokeswoman on Wednesday had no information about plans to visit New Zealand.

McGuirk writes for the Associated Press.

Damon Dash files for bankruptcy, says he owes $25 million

Damon Dash, the hip-hop mogul and record executive who co-founded Roc-A-Fella Records with Jay-Z and Kareem “Biggs” Burke, detailed dire financial straits as he filed for Chapter 7 bankruptcy last week.

The 54-year-old New York native claimed in his voluntary petition, reviewed by The Times, that he is in debt to the tune of $25.3 million. The petition, filed Thursday in Florida, says Dash makes no monthly income and has $4,350 to his name — including $100 in cash, a $500 cellphone and two guns worth $750.

A legal representative for Dash did not immediately respond to The Times’ request for comment on Monday.

Dash’s petition says he owes a total of $25,303,049.47 to as many as 49 creditors, with a majority of that (about $19.1 million) owed to the government in the form of taxes and other debts. He also owes nearly $648,000 in domestic support obligations to ex-wife Rachel Roy and ex-girlfriend Cindy Morales, the petition said. Dash and Roy were married from 2005 to 2009 and share two daughters. Dash shares a son with Morales, and has additional children from other relationships.

The petition confirms reports that Dash’s one-third share of Roc-A-Fella Records was auctioned to the New York Department of Taxation and Finance in August 2024 to help pay off his tax debt. Dash claims he is also owed a “possible” but unspecified amount of money from Burke, and also “unknown” amounts of money from his “possible” claims against actor Claudia Jordan, filmmaker Josh Webber and others he has battled in court.

“Dear Frank” filmmaker Webber and production company Muddy Water Pictures — also mentioned in Dash’s petition — sued the music entrepreneur for copyright infringement and defamation in 2019. A jury sided with the filmmakers in the spring of 2022 and ordered Dash to pay more than $800,000 in damages, but tensions from that decision have dragged into 2025. Webber last month accused Dash and the businessman’s girlfriend of hiding assets that would help pay off the hefty judgment, Complex reported.

Webber also sued Dash for libel and slander in April 2024. Dash was ordered earlier this year to pay the filmmaker $4 million.

As reports of his decision to file for bankruptcy spread, Dash seemingly took ownership of the financial revelations. On Instagram, he reshared a post from hip-hop-centric website WorldStar about his legal woes to his own page.

“Now let’s get to work #staytuned,” Dash captioned his post.

Tim Legler replaces Doris Burke on ESPN’s lead NBA team

ESPN announced some changes Thursday for its NBA broadcast teams going into the 2025-26 season — among them, a promotion for Tim Legler and a contract extension (but also a demotion) for Doris Burke.

Legler will join the network’s lead NBA crew, which also includes play-by-play announcer Mike Breen, fellow analyst Richard Jefferson and reporter Lisa Salters.

That team will call the 2026 NBA Finals on ABC, as well as the conference finals, several first- and second-round playoff games, a Christmas Day game and NBA Saturday Primetime games on ABC.

Legler is a former NBA journeyman who won the league’s three-point shooting contest during the 1996 All-Star festivities. He retired as a player in 2000 and joined ESPN as an analyst the same year.

ESPN did not provide details on Burke’s contract extension, other than to say it is for multiple years. According to a press release, Burke will call “full slates of games throughout the regular season and the NBA playoffs” on ESPN and ABC with play-by-play announcer Dave Pasch.

Burke has been with ESPN since 1991 and joined the network’s lead NBA broadcast team in 2023. When she called the 2024 NBA Finals, she became the first woman to serve as a TV game analyst for a championship-round game in one of the four major professional U.S. men’s sports leagues.

In 2018, Burke received the Naismith Basketball Hall of Fame’s Curt Gowdy Media Award for outstanding contributions to basketball.

The news that Burke’s future with the lead NBA team was up in the air was first reported by The Athletic in June ahead of the 2025 Finals. Indiana Pacers coach Rick Carlisle spoke in support of Burke during his news conference before Game 1.

“She’s changed the game for women in broadcasting,” Carlisle said. “Doris is a great example of courage and putting herself out there.”

Also on Thursday, ESPN announced a multi-year extension for Jefferson, who has been with the network since 2019 and called his first NBA Finals this year.
