Republicans aim to weaken 50-year-old law protecting whales, seals and polar bears

Republican lawmakers are targeting one of the country’s longest-standing pieces of environmental legislation, credited with helping save rare whales from extinction.

GOP leaders believe they now have the political will to remove key pieces of the Marine Mammal Protection Act, enacted in 1972 to protect whales, seals, polar bears and other sea animals. The law also places restrictions on commercial fishermen, shippers and other marine industries.

A Republican-led bill in the works has support from fishermen in Maine who say the law makes lobster fishing more difficult, lobbyists for big-money species such as tuna in Hawaii and crab in Alaska, and marine manufacturers who see the law as antiquated.

Conservation groups adamantly oppose the changes and say weakening the law will erase years of hard-won gains for jeopardized species such as the vanishing North Atlantic right whale, which is vulnerable to entanglement in fishing gear. There are fewer than 400 right whales remaining.

Here’s what to know about the protection act and the proposed changes.

Why the 1972 law still matters

“The Marine Mammal Protection Act is important because it’s one of our bedrock laws that help us to base conservation measures on the best available science,” said Kathleen Collins, senior marine campaign manager with International Fund for Animal Welfare. “Species on the brink of extinction have been brought back.”

It was enacted the year before the Endangered Species Act, at a time when the movement to save whales from extinction was growing. Scientist Roger Payne had discovered that whales could sing in the late 1960s, and their voices soon appeared on record albums and throughout popular culture.

The law protects all marine mammals and prohibits capturing or killing them in U.S. waters or by U.S. citizens on the high seas. It allowed for preventative measures to stop commercial fishing ships and other businesses from accidentally harming animals such as whales and seals. The animals can be harmed by entanglement in fishing gear, collisions with ships and other hazards at sea.

The law also prevents the hunting of marine mammals, including polar bears, with exceptions for Indigenous groups. Some of those animals can be legally hunted in other countries.

Changes to oil and gas operations

Republican Rep. Nick Begich of Alaska, a state with a large fishing industry, submitted a draft this summer that would roll back aspects of the law. The bill says the act has “unduly and unnecessarily constrained government, tribes and the regulated community” since its inception.

The proposal states that it would make changes such as lowering population goals for marine mammals from “maximum productivity” to the level needed to “support continued survival.” It would also ease rules on what constitutes harm to marine mammals.

For example, the law prevents harassment of sea mammals such as whales and defines harassment as activities that have “the potential to injure a marine mammal.” The proposed changes would limit the definition to activities that actually injure the animals. That change could have major implications for industries such as oil and gas exploration where rare whales live.

That poses an existential threat to the Rice’s whale, which numbers only in the dozens and lives in the Gulf of Mexico, conservationists said. And the proposal takes specific aim at the North Atlantic right whale protections with a clause that would delay rules designed to protect that declining whale population until 2035.

Begich and his staff did not return calls for comment on the bill, and his staff declined to provide an update about where it stands in Congress. Begich has said he wants “a bill that protects marine mammals and also works for the people who live and work alongside them, especially in Alaska.”

Fishing groups want restrictions loosened

A coalition of fishing groups from both coasts has come out in support of the proposed changes. Some of the same groups lauded a previous effort by the Trump administration to reduce regulatory burdens on commercial fishing.

The groups said in a July letter to House members that they believe Begich’s changes reflect “a positive and necessary step” for American fisheries’ success.

Restrictions imposed on lobster fishermen of Maine are designed to protect the right whale, but they often provide little protection for the animals while limiting one of America’s signature fisheries, said Virginia Olsen, political director of the Maine Lobstering Union. The restrictions stipulate where lobstermen can fish and what kinds of gear they can use. The whales are vulnerable to lethal entanglement in heavy fishing rope.

Gathering more accurate data about right whales while revising the original law would help protect the animals, Olsen said.

“We do not want to see marine mammals harmed; we need a healthy, vibrant ocean and a plentiful marine habitat to continue Maine’s heritage fishery,” Olsen said.

Some members of other maritime industries have also called on Congress to update the law. The National Marine Manufacturers Assn. said in a statement that the rules have not kept pace with advancements in the marine industry, making innovation in the business difficult.

Environmentalists fight back

Numerous environmental groups have vowed to fight to save the protection act. They characterized the proposed changes as part of the Trump administration’s assault on environmental protections.

The act was instrumental in protecting the humpback whale, one of the species most beloved by whale watchers, said Gib Brogan, senior campaign director with Oceana. Along with other sea mammals, humpbacks would be in jeopardy without it, he said.

“The Marine Mammal Protection Act is flexible. It works. It’s effective. We don’t need to overhaul this law at this point,” Brogan said.

What does this mean for seafood imports

The original law makes it illegal to import marine mammal products without a permit and allows the U.S. to impose import prohibitions on seafood products from foreign fisheries that don’t meet U.S. standards.

The import embargoes are a major sticking point because they punish American businesses, said Gavin Gibbons, chief strategy officer of the National Fisheries Institute, a Virginia-based seafood industry trade group. It’s critical to source seafood globally to be able to meet American demand for seafood, he said.

The National Fisheries Institute and a coalition of industry groups sued the federal government Thursday over what they described as unlawful implementation of the protection act. Gibbons said the groups don’t oppose the act but want to see it responsibly implemented.

“Our fisheries are well regulated and appropriately fished to their maximum sustainable yield,” Gibbons said. “The men and women who work our waters are iconic and responsible. They can’t be expected to just fish more here to make up a deficit while jeopardizing the sustainability they’ve worked so hard to maintain.”

Some environmental groups said the Republican lawmakers’ proposed changes could weaken American seafood competitiveness by allowing imports from poorly regulated foreign fisheries.

Trump dismisses cat-loving NYC Republican candidate for mayor as ‘not exactly prime time’

President Trump on Friday dismissed Curtis Sliwa — his own party’s New York City mayoral candidate — as “not exactly prime time” and even disparaged his affinity for cats, as pressure mounts for Democratic candidate Zohran Mamdani ‘s rivals to drop out of the race.

Trump has warned that Mamdani, a 33-year-old state lawmaker and democratic socialist, will likely cruise to victory over Sliwa, Mayor Eric Adams and former Gov. Andrew Cuomo on Nov. 4 unless two of those candidates dropped out. The New York-born Republican thinks Cuomo could have a chance in a one-on-one race.

On a Friday appearance on “Fox & Friends”, he threw cold water on Sliwa’s mayoral hopes, even taking a shot at the red beret-wearing candidate’s vow to fill the official residence of the New York City mayor with rescue cats if he does win.

“I’m a Republican, but Curtis is not exactly prime time,” Trump said bluntly.

“He wants cats to be in Gracie Mansion,” the president added. “We don’t need thousands of cats.”

Mamdani became the presumed favorite in the race after winning the Democratic primary over Cuomo, who is now running as an independent in the general election. Adams, a Democrat, skipped the primary due to his campaign being sidelined by a now-dismissed federal bribery case.

Two polls conducted in early September, one by the New York Times and Siena University, the other by Quinnipiac University, each showed likely voters favoring Mamdani over Cuomo, with Adams and Sliwa behind Cuomo.

The Quinnipiac poll suggested the gap between Mamdani and Cuomo could narrow if Adams dropped out. The Times/Siena poll suggested that if both Adams and Sliwa withdrew, Mamdani’s advantage over Cuomo could shrink even further.

A campaign spokesperson on Friday stressed that Adams has no intention of stepping down from office or abandoning his reelection bid — though confirmed he is commissioning a poll to gauge his support.

“He just wants to look at all factors,” said Todd Shapiro said. “There’s nothing on the table right now. He’s looking at polls just like he’s doing everything else.”

The mayor, he added, would have more to say on the polling itself next week.

“He’s still very popular,” Shapiro said. “He’s running on a record of success.”

Adams in recent weeks has sought to rebuff questions of whether he might accept an alternate job offer amid reports that he had been approached about potentially taking a role with the federal government.

In a radio interview Friday, Sliwa — the founder of New York’s Guardian Angels anti-crime patrol group — said Trump seems to be responding “to what people are telling him about me without really knowing much about me of late.”

“I would hope the president would revisit my history, not only with him but in this city,” Sliwa said on 710 WOR.

The outspoken New Yorkers both rose to prominence in the late 1970s, but Sliwa has said they haven’t spoken in years, possibly because he’d been critical of Trump at times, both on his long-running radio show and as a candidate.

In a follow up email, Sliwa also defended his love of cats, adding that “animal welfare” is among the issues “New Yorkers care about” that he hopes to focus on, if elected.

“New Yorkers care for people and for animals, and so do I,” he said. “I am proud of my wife, Nancy, who has devoted her life to fostering, caring for, and saving animals, and fighting for them when no one else would.”

Sliwa has sheltered a large collection of rescue cats in his Manhattan apartment and has noted that Gracie Mansion is far more spacious.

“We’ll be able to house unwanted cats and dogs right in the lawn, the great lawn they have,” he said recently on his radio show.

She ran the L.A. animal shelters. Why couldn’t she fix the problems?

Staycee Dains was about a month into her job overseeing the Los Angeles city animal shelters when an employee openly defied her.

Dains asked the employee to clean a kennel. Instead, the employee picked up a hose and sprayed a dog in the face, Dains said.

Dains thought the employee should be fired, but she said the city’s personnel department recommended five days of leave.

Mayor Karen Bass hired Dains in June 2023 after promising to make L.A. “a national model for animal welfare” by turning around its troubled shelters, where dogs may live in overcrowded and dirty kennels and volunteers have complained that animals sometimes don’t get food and water.

But in an interview with The Times, Dains said she felt powerless to solve entrenched problems that included severe understaffing and employees who mistreated or neglected animals.

She said she was repeatedly told by the personnel department, which functions like a human resources department at a private company, that she couldn’t fire problem employees. She also clashed with one of the unions that represents shelter employees.

At one point, Dains even reached out to L.A. County prosecutors for help.

Meanwhile, as the overcrowding worsened, more dogs and cats were euthanized in city shelters under her watch than in the preceding years.

“We need to tell the unfiltered, unvarnished truth about what is happening in the shelters,” Dains said.

In August, after a little more than a year as Animal Services general manager, Dains went on paid leave. A few days later, a top Bass advisor told Dains that her last day would be Nov. 30 and that she was free to resign before then.

Zach Seidl, a Bass spokesperson, pushed back on Dains’ accusations.

“Many of these characterizations are misleading and some are just plain inaccurate,” he said in an email.

Dains, in a series of interviews, said the city does not provide enough funding to meet the basic needs of the animals in its six shelters.

During Bass’ first year in office, amid critical reporting by The Times and others about conditions in the shelters, the mayor offered an 18% budget increase — far less than the 56% the Animal Services department had requested. The following fiscal year, her budget proposal slightly lowered the department’s funding.

Last week, in passing a budget that closed a nearly $1-billion shortfall, the City Council spared Animal Services from major cuts.

Dains, who previously held top shelter jobs in San José and Long Beach, said her employees were desensitized to the suffering of the animals after witnessing it day after day. The understaffing was so bad that three people were responsible for 500 dogs: cleaning kennels, setting up adoptions and working with the medical team, she said.

“I couldn’t sleep knowing that animals were just in those hellholes suffering,” said Dains, who now works at a shelter system in Sacramento. “It was awful.”

Dains, who made about $273,000 a year in L.A., said she witnessed some of her employees “terrorizing” dogs by banging on their kennels, or spraying them with water to move them back. She told the employees to stop the behavior, but some said they had been trained to treat the dogs that way, she said.

To ensure that animals were fed and their enclosures cleaned, Dains suggested starting a schedule that tracked when each task was done. But a union representative worried that the information could be used to punish employees, Dains said.

Ultimately, Dains said, she dropped the proposal because of the opposition from the union, Laborers’ International Union of North America Local 300. A representative from the union declined to comment.

Dain said that personal entanglements and gossip among employees sometimes made it hard to hold them accountable.

Some supervisors had had sexual relationships with their subordinates, which led them to overlook the employees’ poor work performance, according to Dains. Others used the “dirt” they had on co-workers to protest when confronted about their own behavior, she said.

Dains said she suspected that some employees were sleeping during night shifts instead of cleaning cages or doing paperwork. She showed The Times a photo of dog beds arranged on the floor of a staff room like a “nest.”

She said she also witnessed employees watching videos on their phones, rather than working. Others ignored people who walked into the shelter looking to adopt a pet, she said. Some employees told her that colleagues failed to give food or water to cats and dogs.

At the same time, Dains said, other employees went “above and beyond constantly” to make up for those who didn’t pull their weight.

“There’s a significant portion of staff that just aren’t doing their jobs,” she said. “I saw this constantly.”

Dains put some of the blame on supervisors, who were “not requiring them to perform.”

When she tried to discipline supervisors, she faced pushback, she said.

After she put a supervisor on leave who was accused of bullying people, Laborers’ International Union of North America Local 300 filed a grievance against her, Dains said.

A spokesperson for the personnel department declined to comment.

At the same time, Dains acknowledged that she should have been tougher on some of the assistant general managers who reported directly to her. But she said she wanted to maintain working relationships with them.

It is a “tricky thing to do to start writing up executive-level managers that you are trying to work with,” she said.

A shelter employee, who requested anonymity because he didn’t have permission to talk to the media, agreed with Dains’ assessment.

“There’s no accountability, there’s no repercussions,” he said. “And the staff who do work have to work twice as hard.”

A report last year by Best Friends Animal Society, which highlighted the poor conditions in the shelters and suggested possible solutions, criticized Dains as the “biggest barrier” to improvement.

The shelters lacked written protocols, and the euthanasia policy “changed five times in the last year” without communication about the changes, the report said.

According to a Times analysis, the number of dogs euthanized at city shelters from January through September last year increased 72% compared with the same period the previous year. The number of dogs entering the shelters increased each year since 2022, but the number put to death far outpaced the population gain.

In the crowded conditions, animals started behaving poorly and suffered “mental and emotional breakdown,” according to the Best Friends report. That made them less likely to be adopted and more likely to be euthanized.

Dains, in her interview with The Times, defended her euthanasia decisions, arguing that it wasn’t safe for the animals, staff, volunteers or the public to “warehouse” dogs in kennels for months or years.

She said that there was no euthanasia policy when she arrived and that the department was creating one during her tenure.

Bass was Dains’ boss, but Dains’ main contact was Jacqueline Hamilton, deputy mayor of neighborhood services. Dains said she spoke often with Hamilton and told her about the personnel problems and other issues. But Hamilton didn’t offer any meaningful help and didn’t want her to publicize the poor conditions at the shelters, Dains said.

“I am not getting any movement or traction,” Dains told The Times, describing her work experience.

Seidl, the Bass spokesperson, said Dains “was given support to succeed, including assistance in communicating the status of the department to the public and decision makers.”

Dains said that shortly after she became general manager, she asked Deputy Dist. Atty. Kimberly Abourezk, who worked on animal cruelty cases, to send a letter to the mayor about poor conditions at the shelters.

Venusse D. Dunn, a spokesperson for the district attorney’s office, said Abourezk didn’t send the letter because she visited city animal shelters and didn’t find evidence of any crimes.

The office “is not in a position to tell another agency how to operate their facility,” Dunn said.

Annette Ramirez, a longtime Animal Services staffer, is now interim general manager. The “severe overcrowding crisis,” as the department described it in news release this month, continues.
