An elderly man has been released from custody after he was charged over the alleged sexual assault of an 87-year-old woman with dementia at an aged care home in Sydney.
Key points:
- William Newbold, 80, appeared at Parramatta Court via audiovisual link on Sunday
- Police allege he was aware the woman was cognitively impaired
- Mr Newbold is due face court again in March
William John Newbold, 80, was visiting another resident at the facility in the city’s north west when he allegedly entered the woman’s room and had non-consensual sexual contact with her on two occasions earlier in the week.
According to court documents, police allege Mr Newbold sexually touched her on Monday and then had sexual intercourse with her on Thursday.
Police allege he was aware that the woman had a cognitive impairment and therefore could not give consent.
Mr Newbold was arrested at his home in Asquith on Friday and charged with aggravated sexual assault and aggravated sexual touching without consent.
He has no prior criminal history and did not enter pleas to any of the charges when he appeared in Parramatta Court via audiovisual link to apply for bail on Sunday.
His lawyer requested a suppression order, stating there were “significant concerns about the deterioration of Mr Newbold’s cognitive health”.
Magistrate Lyon denied the request citing a lack of medical documentation proving the claim.
Mr Newbold was granted bail. He’s been barred from visiting the aged care home, interfering with witnesses, and endangering the safety of the alleged victim.
He is due face court again in March.
The ABC has chosen not to identify the aged care facility to protect the identity of the alleged victim.
